What does Probationary period mean? A probationary period is the initial, contractually agreed phase of employment used to assess an employee’s suitability, performance and conduct in the role. In England & Wales, Scotland and Northern Ireland it is a descriptive contractual device, not defined by statute. From 6 April 2020, the Employment Rights (Miscellaneous Amendments) Regulations 2019, SI 2019/731, broaden the entitlement to a written statement of employment particulars so that it covers every category of ‘worker’, not only ‘employees’. Taking effect on the same date, the Employment Rights (Employment Particulars and Paid Annual Leave) (Amendment) Regulations 2018, SI 2018/1378, convert this into a day one entitlement that applies when an individual begins work and stipulate that additional details must appear in the statement, including the specific days of the week to be worked (and how these may vary in practice), the terms and conditions governing any paid leave, particulars of any other benefits, and any Probationary period and training Requirements. For further detail, see our reports: LNB News 18/12/2018 123 and LNB News 19/12/2018 122. This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
