Air quality is rising up the agenda for central and local government alike, as well as for infrastructure developers and scheme promoters in the UK. Policy-making has, in the main, been shaped by the Archived EU Ambient Air Quality Directive 2008/50/EC, in the form it had immediately prior to 11 pm on 31 December 2020; that instrument fixed legally enforceable ceilings for concentrations of major air pollutants that impact public health. Defra undertakes a yearly national appraisal of air quality to determine compliance with those limits, and the local air quality management framework requires district and unitary authorities to regularly review and evaluate air quality within their areas on an ongoing basis. The UK has long been non‑compliant with the Archived EU Ambient Air Quality Directive 2008/50/EC, having failed to achieve the limit values for nitrogen dioxide across a large number of its zones and agglomerations. As such, consequently, the government is under a legal duty to prepare an air quality plan (AQP) for any areas that do not achieve the nitrogen dioxide limits.
