This subtopic offers a suite of materials for contracting authorities running a public procurement started before the Procurement Act 2023 (PA 2023) took effect on 24 February 2025. Any in-scope competitions initiated on or after that date fall under PA 2023. By virtue of the PA 2023 transitional and savings provisions, the earlier regimes remain in force insofar as required and appropriate to let contracting authorities finalise, complete and manage procurements begun before PA 2023 commenced (ie procurements that are still ongoing). The discussion here addresses the steps a contracting authority with an ongoing procedure must take once it has reached its contract award decision and prepares to proceed, with an emphasis on the key public procurement routes set out in the Public Contracts Regulations 2015 (PCR 2015), SI 2015/102. It further explores potential issues the parties might face after award, such as dealing with a subsequent modification or responding to a legal challenge. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential.
