What does Adware mean?
Adware describes advertising‑supported software that, once installed or when a linked application runs, automatically serves, injects or downloads advertising to a user’s device. The term is not defined in UK or Irish legislation or case law; it is a descriptive label used across cybersecurity, consumer protection and data protection practice, and is often treated as a “potentially unwanted programme”. Typical features include bundling with other downloads, persistent display of ads, and tracking of user behaviour. Its legal significance commonly arises from: - Privacy and cookies/ePrivacy rules: storing or accessing information on a device for advertising or tracking generally requires informed, prior consent (UK PECR reg 6; Ireland’s ePrivacy Regulations 2011, reg 5(3)), alongside transparency and lawful basis under UK GDPR/EU GDPR where personal data are processed. - Consumer law: undisclosed or misleading bundling or behaviour may breach unfair commercial practices rules (UK CPRs 2008; Ireland’s Consumer Protection Act 2007) and digital content quality obligations (UK Consumer Rights Act 2015; Ireland’s Consumer Rights Act 2022). - Cybercrime risk: covert installation or operation that circumvents user authorisation may amount to unauthorised access or similar offences (e.g., UK Computer Misuse Act 1990), depending on the facts.
