What does BPSS mean?
In legal practice, BPSS describes the UK Government’s baseline pre‑employment screening required before individuals (including contractor staff) are given routine access to government assets, premises, IT systems or information classified as OFFICIAL. It is not a national security clearance, but is often a prerequisite for CTC, SC or DV. BPSS checks typically cover identity verification, nationality and immigration/right to work, a three‑year employment history (with explanations for gaps), and unspent criminal convictions via a basic criminal record check (DBS in England and Wales, Disclosure Scotland, or AccessNI). The standard is set out in Cabinet Office guidance (including the Security Policy Framework and HMG/GovS 007 personnel security controls) rather than primary legislation, and is widely referenced in public sector procurements, outsourcing and supply‑chain security clauses. Processing BPSS data engages UK GDPR and the Data Protection Act 2018 (including Article 10 criminal‑offence data and appropriate policy document requirements). Usage is consistent across England & Wales, Scotland and Northern Ireland. In Ireland, “BPSS” has no formal legal status; contracting authorities may call for equivalent baseline screening, but Garda vetting only applies to “relevant work” under the National Vetting Bureau Acts, and employers must comply with Irish employment and data protection law when requesting background checks.
