What does Construction Contractor mean?
In legal practice, a construction contractor is the company or other entity engaged under a building or engineering contract to carry out and complete the works, often on a design and build basis (also referred to as the main contractor). In PPP/PFI structures, the project company (Project Co) typically appoints a construction contractor to design and build the project facilities. The term is descriptive rather than defined by statute or case law; rights, obligations and risk allocation are determined by the contract and applicable law. Core responsibilities usually cover delivery to programme, price and specified standards, compliance with planning, building regulations and health and safety, any assumed design liability, supply‑chain management, testing/commissioning, achievement of practical completion and defects rectification. Contracts commonly include performance security (performance bond and/or parent company guarantee), insurance, collateral warranties or third‑party rights, retention and liquidated damages for delay. Usage is broadly consistent across England & Wales, Scotland, Northern Ireland and Ireland, with equivalent roles under standard forms (JCT and NEC in E&W/NI, SBCC in Scotland, and Public Works or RIAI contracts in Ireland).
