What does Defined benefit scheme mean?
A defined benefit scheme is an occupational pension that promises a set level of retirement income determined by a formula, usually an accrual rate applied to pensionable service and pensionable earnings, rather than by investment performance. In UK and Irish pensions legislation the term distinguishes salary-related benefits from money purchase/defined contribution benefits. Typical features include final salary or career average revalued earnings (CARE) designs; statutory revaluation of deferred benefits and, where applicable, indexation in payment; employer responsibility for funding, investment and longevity risk; and trustee obligations to operate a statutory scheme-funding regime supported by periodic actuarial valuations and recovery plans. Across England & Wales, Scotland and Northern Ireland, DB schemes are regulated under the Pensions Acts, are subject to the statutory funding objective, and a section 75 employer debt can arise on employer exit or winding-up; schemes may qualify for Pension Protection Fund (PPF) compensation on insolvency. In Ireland, the Pensions Act 1990 applies, with a funding standard and funding reserve, statutory wind-up priorities and oversight by the Pensions Authority, but no PPF equivalent. DB schemes frequently feature in corporate transactions and restructurings, scheme closure or benefit redesign, liability management exercises, bulk transfers and insurer buy-ins/buy-outs.

The Pensions Regulator (the Regulator) The Regulator is an arm’s-length public body set up under the Pensions Act 2004 (PeA 2004). Its authority to impose contribution notices and financial support directions appears in PeA 2004, ss 38–50. Although the Act does not use the label, these provisions are widely known as the Regulator’s ‘moral hazard’ powers. Their purpose is to counter the ‘moral hazard’ arising from the Pension Protection Fund (PPF): the possibility that corporate groups might organise their structures so as to heighten exposure within their pension schemes, comfortable that the PPF would intervene if the employer entered insolvency.
