What does Design mean?
Design in legal practice means the visual appearance of the whole or part of a product—its lines, contours, colours, shape, texture, materials or ornamentation—rather than how it works. The concept is defined in statute for key regimes (UK Registered Designs Act 1949; UK CDPA 1988 Part III; EU Community Design Regulation; Ireland’s Industrial Designs Act 2001). Protection typically arises through: - registered designs (UK, Ireland and EU), requiring novelty and individual character and protecting appearance; - unregistered protection—UK unregistered design right (shape/configuration only, excluding surface decoration), plus the UK supplementary unregistered design and the EU unregistered Community design (appearance), which arise on first disclosure; and - copyright in qualifying artistic works. Post‑Brexit, EU design rights no longer extend to the UK; Ireland remains within the EU design system. Across England & Wales, Scotland and Northern Ireland, the UK regimes apply consistently. Practice points: first disclosure can determine whether SUD or UCD arises; registered protection can last up to 25 years; UK UDR up to 10/15 years; UCD/SUD three years. Purely functional or must‑fit features are excluded. Keep dated records of creation and disclosure to support infringement claims.
