European Economic Area (EEA) national meaning

What does European Economic Area (EEA) national mean?
In legal practice, eea national describes a person who is a national of an EEA State — any EU Member State plus Iceland, Liechtenstein and Norway. The term is used across immigration, employment, social security and regulatory law, and is defined in particular instruments (for example, the now‑revoked UK Immigration (European Economic Area) Regulations 2016 and Ireland’s free movement regulations) in substantially this way. EEA States are: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, and Iceland, Liechtenstein and Norway. Switzerland is not an EEA State. UK position: the UK is not an EEA State. Post‑Brexit, references to EEA nationals in UK law mainly concern citizens’ rights (including under the Withdrawal Agreement, the EU Settlement Scheme and saved rights), legacy right to work checks and, in England, right to rent checks, and residual recognition and professional qualification regimes. Ireland: usage aligns with EU free movement law; EEA nationals (and qualifying family members) retain free movement and residence rights under Directive 2004/38/EC and national regulations. Usage is consistent across England & Wales, Scotland and Northern Ireland, subject to Brexit‑related savings and transitional provisions.

EU/EEA Citizens’ Directive: durable partners and other family members—definitions, evidential criteria, facilitation duties, and rights of entry and residence

Under Directive 2004/38/EC, the Citizens’ Directive Nationals of the European Economic Area (EEA)—which includes the EU Member States, Norway, Iceland and Lichtenstein—benefit from EU free movement law. In this Practice Note, references to ‘EU citizens’, meaning nationals of EU Member States, are understood to include EEA nationals. Brexit impact The UK ceased to be an EU Member State on exit day, 31 January 2020. Under the Withdrawal Agreement, the state pension and benefit rights of UK nationals residing in the EU, European Economic Area (EEA) or Switzerland are protected. EU/EEA Prospectus Directive: when a prospectus is required in debt capital markets, key exemptions, passporting and unregulated market listing options

BREXIT: From 31 January 2020, the UK ceased to be an EU Member State and moved into an implementation phase, during which, for many matters, the EU continues to treat it as if it were a Member State across a range of areas. In its capacity as a third country, the UK is excluded from the EU’s political institutions, agencies, offices, bodies and governance frameworks (save to the limited extent agreed), yet it must keep to its obligations under EU law (covering EU treaties, legislation, principles and international agreements) and remain subject to the ongoing jurisdiction of the Court of Justice of the European Union in line with the transitional regime in Part 4 of the Withdrawal Agreement.
