Filing meaning

What does Filing mean?
Filing is the act of submitting a document to a court, tribunal or relevant registry so it becomes part of the official record for a case or application. In litigation, it is the delivery by a party or prospective party of documents such as a claim form, defence, evidence or application notice to the court office, increasingly via electronic filing. The concept is governed by procedural rules rather than a single statute. In England and Wales, the Civil Procedure Rules define how and when to file (including e‑filing systems). Northern Ireland follows the Rules of the Court of Judicature. In Scotland, the equivalent act is generally described as lodging under the Rules of the Court of Session and sheriff court rules. In Ireland, filing/lodgement is governed by the Rules of the Superior and Circuit Courts, with expanding eFiling. Key features include: time- and date-stamped receipt determining compliance with procedural deadlines; payment of any filing fee; and acceptance subject to prescribed form, content and method. Filing is distinct from service on other parties. Proof of filing is usually a sealed copy or electronic acknowledgement. Usage is broadly consistent across the UK and Ireland, though “lodging/lodgement” is more common in Scotland and Ireland.
