What does Financial order mean?
A financial order is a court order in family proceedings directing how money, property or pensions are to be provided, shared or transferred between spouses or civil partners (including former spouses or civil partners), or for the benefit of a child. In England and Wales, “financial order” is defined in the Family Procedure Rules 2010 and commonly includes: periodical payments (spousal maintenance), secured periodical payments, lump sums, property adjustment orders (including sale/transfer), pension sharing/attachment, and financial provision for a child under Schedule 1 to the Children Act 1989. Such orders are typically made on divorce, dissolution, nullity or judicial separation, can be varied in defined circumstances (notably maintenance), and are enforceable. The court may aim for a “clean break” where appropriate. In Northern Ireland, broadly equivalent orders are available under the Matrimonial Causes (Northern Ireland) Order 1978 and related rules; practice and order types largely mirror England and Wales, though “ancillary relief”/“financial provision” are also used. In Scotland, the court grants “orders for financial provision” under the Family Law (Scotland) Act 1985 (capital sum, property transfer, periodical allowance and pension sharing), and “aliment” for children. “Financial order” is a descriptive term.
