FM Contractor meaning

What does FM Contractor mean?
An FM contractor is the facilities management contractor engaged by the project company (Project Co/SPV) under an FM contract to operate, maintain and support the completed facilities for the service term. The term is descriptive rather than defined by legislation or case law, and is used across PPP/PFI, DBFM and estates outsourcing (often also called the FM services provider or O&M contractor). Typical scope covers hard FM (fabric and M&E), soft FM (cleaning, security, catering), statutory compliance, helpdesk, reactive and planned maintenance, and lifecycle renewal/capital replacement. Performance is linked to an availability and performance-based payment mechanism, with service credits or deductions for failures. Appointment is timed to service commencement following completion/acceptance of the works. Key contractual features include management of employee transfers under TUPE (UK) or the 2003 TUPE Regulations (Ireland), health and safety compliance, insurance, and interfaces with the construction contractor. Security often includes a parent company guarantee and/or performance bond, with collateral warranties and a direct agreement granting funders and the contracting authority step-in rights. Usage is broadly consistent across England and Wales, Scotland, Northern Ireland and Ireland. While delivery models differ (e.g. UK PFI/DBFM, Wales’ MIM, Irish PPPs), the FM Contractor’s role is substantively the same.
