ICT meaning

What does ICT mean?
In legal practice, ICT means information and communications technology: the hardware, software, networks and services used to create, process, store and transmit information, including cloud and telecoms, and the support that keeps them running. The term is broad and descriptive (often used interchangeably with IT and telecoms) and is generally not defined in UK or Irish legislation or case law; its scope is set by the relevant contract, policy, procurement or regulatory context. Lawyers encounter ICT in technology contracts (software licensing, cloud/SaaS, managed and network services), outsourcing and public procurement, cybersecurity and data protection compliance, and telecoms regulation. Key legal issues typically include service levels and availability, information security standards, data protection (UK GDPR/EU GDPR and national implementing acts), data residency and transfers, incident response, business continuity and disaster recovery, intellectual property and open-source, confidentiality, audit, change control and exit/transition. Usage is broadly consistent across England and Wales, Scotland, Northern Ireland and Ireland. Applicable law and regulators differ (for example Ofcom in the UK and ComReg in Ireland; UK GDPR/DPA 2018 v EU GDPR/Irish Data Protection Act 2018; UK NIS Regulations v Irish NIS regime), so contracts often state governing jurisdiction and compliance requirements for ICT systems or services.

HC 813: Overhaul of Tier 2 ICT to Appendix Intra-Company Routes - cooling-off, high earners, switching and financial requirements (UK Immigration Rules from 1 December 2020)

Applications submitted before this date will be determined under the Rules in effect on 30 November 2020. See: LNB News 22/10/2020 80. The Migration Advisory Committee (MAC) has been asked to examine the Intra-Company Transfer route and to report on issues including salary and skill thresholds, whether separate arrangements should exist for high earners, and points of divergence from the Skilled Worker route. The MAC aims to provide its findings by the end of October 2021. Any adjustments to the route are expected to follow in 2022. See: LNB News 07/10/2020 76. Appendix Intra-Company Routes The Tier 2 (Intra-Company Transfer) (ICT) route will be retitled as the Intra-Company routes, as flagged in the Home Office’s July 2020 further details paper. UK Immigration Skills Charge: regulatory framework, applicability, exemptions (including EU TCA), 2025 rate increase, refunds and sponsor compliance for Skilled Worker and Senior or Specialist Worker routes

Background In December 2015, the Migration Advisory Committee (MAC)—an independent arm’s length public body advising government on immigration—issued a comprehensive assessment of Tier 2 policy. At that point, Tier 2 encompassed the skilled worker pathways. Among its proposals, the MAC suggested an Immigration Skills Charge (ISC) to encourage UK employers to ‘reduce their reliance’ on migrant labour and channel resources into training and upskilling domestic workers. The Committee examined this at the government’s specific request, and provision for an ISC already appeared in the Immigration Bill then before Parliament, which later became the Immigration Act 2016 (IA 2016). The MAC advised that the levy should apply to all sponsoring employers hiring via Tier 2 (General) and (Intra-Company Transfer) (ICT) routes, save for cases where individuals were sponsored under the Graduate Trainee and the (then still operating) Skills Transfer ICT sub-categories.
