Menter Newydd refers to the project delivery consortium for the proposed Wylfa Newydd nuclear power station in Wales: an unincorporated (contractual)
joint venture between
hitachi nuclear energy europe limited, Bechtel Management Company Limited and JGC New Energy Limited. It was appointed by Horizon Nuclear Power to provide a broad scope of services, including a significant proportion of on-site construction and EPC-type delivery activities.
The term is not defined in legislation or case law; it is a proper name used in procurement, construction and projects documentation for Wylfa Newydd. As an unincorporated joint venture, the participants remained separate legal entities and carried rights and obligations to Horizon under the JV and project contracts, including allocation of design, construction, programme and interface risk and, where agreed, joint and several liability.
The usage and legal analysis are broadly consistent across England and Wales, Scotland, Northern Ireland and Ireland: Menter Newydd describes a contractual consortium rather than a separate corporate vehicle, with issues typically arising around governance, authority to bind, indemnities, insurance and flow-down to the supply chain.
Note: Following suspension of the Wylfa Newydd project (2019) and
hitachi’s withdrawal (2020), the Menter Newydd arrangements have been wound down.
