What does New Deal for Consumers mean?
In practice, New Deal for consumers describes the EU’s 2018 package to modernise consumer protection and strengthen enforcement, rather than a single defined legal instrument. It chiefly refers to two measures now in force across the EU: Directive (EU) 2019/2161 (the Omnibus Directive) and Directive (EU) 2020/1828 (the Representative Actions/Collective Redress Directive). Key features include: enhanced transparency for online marketplaces (ranking, reviews, personalised pricing), rules on price reduction announcements, updates to withdrawal rights and information duties (including for digital content/services provided in exchange for personal data), a ban on dual quality practices likely to mislead, stronger remedies for unfair commercial practices, and significantly higher penalties. The Representative Actions regime enables qualified entities to seek injunctive and redress measures for consumers’ collective interests in cross-border cases. Jurisdictionally, the package applies in EU Member States, including Ireland, which has implemented both directives and commenced a representative actions regime in 2023. It does not apply in Great Britain or Northern Ireland post-Brexit. However, UK traders targeting EU consumers must comply with relevant Member State rules. The UK is pursuing analogous domestic reform via the Digital Markets, Competition and Consumers Act 2024, which strengthens enforcement and consumer protection.
