Non-disclosure meaning

What does Non-disclosure mean?
In insurance practice, non-disclosure is the insured’s failure to share a material fact before inception, renewal or variation that would have influenced the insurer’s assessment of the risk, the policy terms or the premium. The expression is descriptive rather than a defined term; the applicable duties and remedies arise from legislation and case law. In England & Wales, Scotland and Northern Ireland, consumer insurance is governed by the Consumer Insurance (Disclosure and Representations) Act 2012: there is no general duty to volunteer information; the consumer must take reasonable care not to misrepresent when answering the insurer’s questions. For non‑consumer insurance, the Insurance Act 2015 imposes a duty of fair presentation: the insured must disclose every material circumstance known (or that ought to be known) or enough to put a prudent insurer on notice to enquire further, in a manner that is reasonably clear and accessible. Remedies are proportionate: deliberate or reckless non‑disclosure permits avoidance; otherwise the insurer may treat the contract on amended terms, charge an adjusted premium or reduce the claim. Banks experienced an accumulation of NPLs in their books when borrowers' inability to repay was intensified by the financial crisis and subsequent recessions. When NPLs are proportionately high, banks' capacity to manage the riskiness of their lending is diminished. NPLs are a supervisory priority for the European Central Bank (ECB), which monitors the overall level of NPLs across euro area banks.
