What does Non-molestation order mean?
A non‑molestation order is a protective family law injunction that stops a person from harassing, threatening, intimidating or using violence against a partner, former partner or child. In England and Wales it is granted under Part IV of the Family Law Act 1996 and prohibits a respondent from molesting an “associated person” (as defined in the Act) or a relevant child. “Molestation” is not exhaustively defined in statute; case law interprets it broadly to include violence, harassment, pestering, coercive control and unwanted contact (including online). Orders typically include no‑contact provisions and bans on attending a home, workplace or school. They are often obtained urgently, including without notice, for a fixed period (commonly 6–12 months) or until further order. Breach is a criminal offence enforceable by the police. Non‑molestation orders are frequently sought alongside an occupation order. In Northern Ireland, similar non‑molestation orders are available under the Family Homes and Domestic Violence (Northern Ireland) Order 1998; breach is likewise a criminal offence. In Scotland, equivalent protection is obtained by interdict (often with a power of arrest) or a non‑harassment order. In Ireland, comparable relief is provided by safety orders and interim protection orders under the Domestic Violence Act 2018.

Dyson secures UPC injunction over Airwrap patent against Dreame; Spain included via importer link, UK excluded despite Northern Ireland Windsor Framework; court broadens claim scope and finds imminent infringement

On 7 April 2026, Dyson secured an interim injunction against Chinese rival Dreame after the UPC tribunal held that the ‘Dazzle’ hair styler infringed Dyson’s patent, compelling a suspension of sales throughout all UPC Member States and Spain. The Hamburg Local Division explained that including Spain (despite it not being a UPC Member State) was warranted because Dreame’s EU-based importer was actively putting the goods on the Spanish market, thereby creating a sufficiently close jurisdictional connection to hear the claims together under EU jurisdictional rules. The panel, chaired by Sabine Klepsch, declined to stretch the order to the UK. Citing the UK–EU Windsor Framework, under which certain EU product safety requirements still apply in Northern Ireland and oblige non‑EU manufacturers to appoint an EU-based representative to place goods there, Dyson argued this regulatory nexus tied UK sales to the EU and could ground UPC jurisdiction. It is assumed that the landlord has instituted proceedings to forfeit the lease due to non-payment of rent. Given the claim has succeeded, it is further assumed the lease contained a clause authorising re-entry upon non-payment of rent, and that either the arrears were duly demanded or section 210 of the Common Law Procedure Act 1852 applies, with at least six months’ rent outstanding and insufficient distress available on the premises to satisfy the arrears, in which situation any demand is dispensed with.
