What does Notification of primary conclusions mean?
A notification of primary conclusions is the pensions ombudsman’s provisional view on a pension complaint: a draft decision setting out the facts found, issues, proposed findings and any intended directions or redress, and inviting final representations before a binding determination is issued. It is not a term defined in legislation or case law; it is a procedural label used in practice (also described as a notification of preliminary conclusions, preliminary decision, opinion or draft determination). Key features and use: - Issued towards the end of the investigation to ensure procedural fairness. - Provides a last opportunity for parties to correct factual errors, submit further evidence or address points of law. - Carries a stated deadline; silence may result in a final determination in similar terms. - Not itself appealable; any challenge lies after the final determination (for example, by appeal or judicial review, as applicable). Jurisdiction: - In England & Wales and Scotland, this step is used by The Pensions Ombudsman. - In Northern Ireland, the Pensions Ombudsman for Northern Ireland follows a comparable provisional decision stage. - In Ireland, the Financial Services and Pensions Ombudsman issues a preliminary decision for comment, though the terminology differs.
