On-premises contract meaning

What does On-premises contract mean?
In practice, an on‑premises contract is a consumer contract concluded face‑to‑face at the trader’s business premises (for example, a shop, office or showroom), rather than at a distance or away from those premises. Legally it is a residual category: in the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and in Ireland’s Consumer Rights Act 2022 (continuing the Consumer Rights Directive approach), an on‑premises contract is a trader–consumer contract that is neither a distance contract nor an off‑premises contract. Typical examples include buying goods at a retail counter, signing a repair or maintenance agreement in a garage, or agreeing professional services in the provider’s office. Key features and practical significance are that: (i) more limited pre‑contract information duties apply than for distance or off‑premises contracts; and (ii) there is generally no statutory 14‑day cooling‑off period (subject to other consumer protections and remedies). Usage and effect are broadly consistent across England and Wales, Scotland, Northern Ireland and Ireland. The concept focuses on where and how the contract is concluded, with “business premises” covering locations where the trader permanently or habitually carries on business, including certain mobile premises, provided the agreement is made there.

A well-known problem amongst procurement professionals A widely recognised headache for procurement practitioners arises from the duty in regulation 53 of the Public Contracts Regulations 2015 (PCR 2015), SI 2015/102 (PCR 2015, SI 2015/102, reg 53). It requires the ‘procurement documents’ to be accessible at the time a public contract is advertised in the Official Journal of the European Union (the Official Journal, or OJEU).
