Practice form meaning

What does Practice form mean?
A practice form is a prescribed court form or template to be used for a specific procedural step, with its purpose, content and format set out in a practice direction or the applicable court rules. The expression is descriptive rather than a term defined by legislation or case law, and is used across civil, family and criminal procedure to denote the standard forms published with practice directions or in rules. Across the UK and Ireland, usage is broadly consistent: - England and Wales: forms are issued under the Civil Procedure Rules, Family Procedure Rules and Criminal Procedure Rules and their practice directions (often numbered, for example “N” forms). Some are mandatory; filing on the wrong form or in the wrong format can lead to rejection, delay or costs sanctions. - Scotland: forms are mainly prescribed in schedules to the Rules of the Court of Session and Sheriff Court rules; practice notes or directions may provide additional templates. - Northern Ireland: forms are in the Rules of the Court of Judicature and County Court Rules and in practice directions. - Ireland: forms are set out in the Rules of the Superior, Circuit and District Courts and associated practice directions. Although the outcome may catch seasoned credit hire practitioners off guard, it was driven in large part by the precise language of the debarring order in this case. The order confined any future debarring strictly to the question of rate and made no reference to reliance on impecuniosity for the hire period or for any wider purposes; appellant counsel on appeal suggested this flowed from a legacy version of a standard form. Practitioners familiar with credit hire litigation will know that, more often than not, directions orders bar a claimant from reliance on impecuniosity for all purposes following a failure to provide financial disclosure. Agricultural holdings disputes in Scotland: Scottish Land Court jurisdiction, exceptions, procedures and remedies; arbitration, mediation and appeals

For many years, virtually every disagreement about agricultural tenancies was sent to arbitration at the outset. The rationale was that questions concerning agricultural holdings often have a strong practical dimension, so arbitration was thought a more suitable forum than the courts. This reflected the earlier assumption that practical considerations predominated in such cases, making a court reference less apt back then. Over time, however, matters of considerable legal intricacy also came before arbitrators. With the enactment of the Agricultural Holdings (Scotland) Act 2003 (AH(S)A 2003), policy shifted, and the main route for resolving disputes about agricultural tenant issues is now referral to the Scottish Land Court. At the same time, arbitration procedures were streamlined, and alternative processes, eg mediation, were enabled.
