Rectification meaning

What does Rectification mean?
Rectification, in land registration practice, is the alteration of the register of title to correct a mistake that adversely affects a registered proprietor’s title. In England and Wales, the Land Registration Act 2002 (Schedule 4) defines rectification as an alteration correcting a mistake which prejudicially affects the title of a registered proprietor; it may be ordered by the court or made by HM Land Registry in limited cases, with indemnity generally available for loss. Typical situations include erroneous entries, wrongful cancellations, boundary and description errors, and registrations obtained by fraud. In Scotland, under the Land Registration etc. (Scotland) Act 2012, the Keeper must rectify an inaccuracy in the Land Register, subject to protections for good‑faith acquirers and the realignment of rights regime; compensation may be payable. In Northern Ireland, the Land Registration Act (NI) 1970 permits rectification by the court or the Registrar to correct errors in the register, with indemnity provisions. In Ireland, the Property Registration Authority may rectify a folio to correct errors or omissions, and the court can order rectification; statutory compensation is available. Rectification of the register is distinct from the equitable remedy of rectifying a written instrument that fails to reflect the parties’ true agreement.

Section 27 of the Act, addressing the rectification of arbitral awards, derives from Article 33 of the UNCITRAL Model Law. Jurisprudence remains sparse on both the ambit and the process governing a tribunal’s power to correct its award. First, the Court examined whether the amendments ran counter to the tribunal’s own reasoning in the Original Award, and whether they fell outside ‘errors in computation, clerical or typographical slips, omissions, or comparable mistakes’. The Court concluded that this argument was legally misguided: the Tribunal had never dismissed the claim for the Return sought in the Statement of Claim, as asserted by the Borrowers.
