What does Refund of excess contributions lump sum mean?
A refund of excess contributions lump sum is a payment by a UK registered pension scheme returning to a member the part of their pension contributions that did not qualify for UK tax relief (for example, amounts above the individual’s relievable earnings). It is defined for tax purposes in paragraph 6, Schedule 29 to the Finance Act 2004 and, if the statutory conditions are met, counts as an authorised member payment. Key features and practice points: - Used where excess, non-relievable member contributions are identified (e.g., under relief at source or net pay arrangements, or following HMRC notification). - Limited to the unrelieved excess; it is not a mechanism to address annual allowance charges. - Tax treatment: generally subject to PAYE income tax when paid, avoiding unauthorised payment charges provided the legislative conditions are satisfied. - Distinct from a short service refund lump sum or other leaver refunds. The concept and terminology are specific to UK pensions tax law and are applied consistently across England & Wales, Scotland and Northern Ireland.
