What does Register of Title mean?
In practice, the register of title is the publicly searchable record of who owns land and what rights, charges and burdens affect it. The term is descriptive; each jurisdiction’s land registration legislation establishes the relevant register. England and Wales: HM Land Registry holds a title register and title plan for each title number, split into the Property, Proprietorship and Charges sections. Scotland: the Land Register of Scotland (Registers of Scotland) provides a title sheet (Sections A–D: Property, Proprietorship, Securities, Burdens) and cadastral map. Northern Ireland: Land Registry NI keeps the title register and map for each title/folio, recording ownership and encumbrances. Ireland: the Property Registration Authority (Land Registry) maintains a folio and filed plan for each title. Typical entries include the registered proprietor, property description and boundaries, class of title, mortgages/standard securities, easements/servitudes, leases and restrictive covenants/burdens. Searches and official/office copies are available and relied on for conveyancing due diligence, priority and enforcement. Registered title benefits from state-backed guarantees and statutory protection of priority.
