Sequel rights meaning

What does Sequel rights mean?
In practice, sequel rights are the contractual rights to produce, and to authorise others to produce, a further film (often also television or streaming content) that features substantially the same principal characters as the original screenplay, work or film, but tells a substantially different storey—whether set before, during or after the original events (including prequels and interquels). This is a descriptive industry term, not defined in UK or Irish legislation or case law. Its scope is determined by contract and underlying copyright. Key features typically include: exclusivity; the right to licence third parties; identification of covered media (feature film, TV, streaming); character and element use; approvals; and payment terms (e.g. purchase price, bonuses or contingent compensation). Sequel rights are commonly granted or reserved in option and purchase agreements, rights acquisition agreements, production, co‑production and distribution documents, and are often negotiated alongside remake, spin‑off and character merchandising rights. Across England & Wales, Scotland, Northern Ireland and Ireland, usage is broadly consistent: enforceability turns on clear drafting, chain of title and any limits arising from copyright in the underlying work and the protectability of characters, as well as any retained rights of authors or prior rights holders.

See Practice Note: Collecting societies. Recapture or turnaround provision ‘Recapture’ states that a licence will lapse and all rights will automatically return to the author/owner after a defined period if, by its end, the producer has not carried out specified actions. ‘Turnaround’ grants the author/owner, within a set timeframe, the ability to notify the producer requiring reassignment of certain project rights in exchange for payment of particular sums.
