State pension date meaning

What does State pension date mean?
The state pension date is the calendar date on which an individual first becomes entitled to draw the State Pension, assuming a valid claim is made. In practice it aligns with the date the person reaches State Pension age. This is a descriptive term used across pensions, employment and litigation practice; the underlying State Pension age and entitlement conditions are set by statute. In England & Wales, Scotland and Northern Ireland, the UK State Pension age varies by date of birth and is subject to statutory review. In Ireland, the State Pension (Contributory/Non‑Contributory) has its own statutory age rules. In both systems, payment normally starts only on claim; entitlement can be deferred, and limited backdating may apply under the relevant legislation. The state pension date is commonly referenced in pension scheme rules (for example, where a scheme’s normal retirement age tracks State Pension age), in drafting and advising on bridging/offset arrangements, and in calculating loss of earnings, maintenance, or redundancy exposures to a State Pension age endpoint. Usage is broadly consistent across England & Wales, Scotland, Northern Ireland and Ireland, but advisers must apply the jurisdiction‑specific State Pension age, claim, deferral and backdating rules to fix the correct date.

The auto-enrolment duty Since 1 October 2012, at their staging date employers must auto‑enrol eligible jobholders into a qualifying pension scheme, allow opt‑outs, pay minimum contributions, and re‑enrol every three years. Protected rights under money purchase (DC) contracting-out before 6 April 2012: scheme types, funding sources, and statutory restrictions on benefits, annuities, transfers and lump sums

‘Protected rights’ were the benefits that schemes contracted-out on a money purchase basis had to deliver, before 6 April 2012, to members who had contracted-out, replacing the state benefits foregone as a result of doing so. For further details on contracting-out, see Practice Note: What does ‘contracting-out’ mean for pension lawyers? Contracting-out on a money purchase basis (DC contracting-out) first became available in April 1988, but it was abolished on 6 April 2012. From that date, it was no longer possible to build up protected rights and the statutory restrictions that had applied to protected rights accrued before then ceased to operate. In practice, this means former protected rights can be treated as ordinary scheme benefits, except where the scheme rules provide otherwise.
