Statutory scheme meaning

What does Statutory scheme mean?
Statutory scheme describes a scheme whose structure, powers and member entitlements are created directly by legislation. In legal practice it is a descriptive expression for the framework established by an Act and subordinate legislation, rather than a universal defined term. In pensions work, it commonly means a public service pension scheme (a statutory pension scheme) for public sector employees established by or under statute, such as the Civil Service, NHS, Teachers’ and Police schemes. Key legal features include benefits and governance prescribed in primary and secondary legislation (not by trust deed), amendments made by Act or statutory instrument, and disputes handled through statutory processes and, where appropriate, judicial review. This distinguishes statutory schemes from private occupational pension schemes set up under trust and contract. Usage is broadly consistent across the UK and Ireland. In England and Wales and Scotland, most public service pension schemes operate under the Public Service Pensions Act 2013 and scheme regulations; in Northern Ireland, under the Public Service Pensions Act (Northern Ireland) 2014; and in Ireland, under legislation such as the Public Service Pensions (Single Scheme and Other Provisions) Act 2012.

This Q&A This Q&A considers how the Housing Act 2004 (HA 2004) applies to assured shorthold tenancies (ASTs) governed by the Housing Act 1988 (HA 1988). In brief, when a landlord takes a deposit for an AST, two actions are required within 30 days of receiving the funds. First, the initial requirements of an authorised tenancy deposit scheme must be satisfied in full (HA 2004, s 213(3)). Secondly, the tenant must be provided with specified prescribed information (HA 2004, s 213(5)(6)). The relevant prescribed information is set out in the Housing (Tenancy Deposits) (Prescribed Information) Order 2007, SI 2007/797.
