Sustainability Measures meaning

What does Sustainability Measures mean?
In legal practice, Sustainability Measures describes the concrete actions, standards and controls a party agrees to implement, and to cascade through its supply chain, to achieve environmental and wider ESG outcomes under a contract or policy. It is not a term defined by UK or Irish legislation or case law; it is a descriptive, contract-defined expression used across procurement, supply, construction, outsourcing, finance and public sector contexts. Typical features include: adopting circular economy principles; waste prevention and management; water stewardship; energy efficiency; greenhouse gas emissions reduction (including Scope 3); pollution prevention; resource efficiency; and reducing adverse impacts on nature and biodiversity. Measures commonly require targets and KPIs, governance and training, risk assessments, supplier due diligence, reporting and audit rights, independent verification or certification (for example, recognised environmental management systems), corrective action plans and continuous improvement. In England & Wales, Scotland, Northern Ireland and Ireland, usage is broadly consistent, with the content and evidential requirements shaped by applicable environmental, climate and sustainability reporting laws, public procurement rules and sector guidance. Monitoring and reviewing anti-bribery and corruption procedures under the Bribery Act 2010: practical mechanisms, risk triggers and board reporting

Section 7 of the Bribery Act 2010 (BA 2010) introduced a corporate criminal offence of failing to prevent bribery. A defence is available where a commercial organisation can show it had adequate procedures in place to prevent it. The Ministry of Justice (MoJ) has published guidance on the procedures organisations should adopt to prevent bribery, framed around six principles. These principles are not prescriptive; they are designed to be flexible and outcome-focused. Bribery prevention measures should be proportionate to the organisation’s risk exposure. Once established, they should be monitored, reviewed and evaluated, a point reinforced by MoJ principle 6—Monitoring and review. This Practice Note sets out the applicable product governance obligations under the Markets in Financial Instruments Directive (Directive 2014/65/EU) (MiFID II) that firms must observe and comply with when designing, approving, marketing and overseeing the ongoing management of products throughout their entire lifecycle.
