Timetable meaning

Published by a LexisNexis Family expert
What does Timetable mean?
In practice, a timetable is the court-approved schedule of steps and hearing dates that structures a case. It sets deadlines for pleadings, disclosure, expert evidence and hearings, usually through case management directions. It is a descriptive term; the detail is set by court rules and practice directions. England and Wales: in public law children cases under the Public Law Outline (FPR 2010 PD12A), proceedings should conclude within 26 weeks from issue (Children Act 1989, s.32). The court sets a timetable for the proceedings and a child’s timetable, having regard to the child’s welfare and developmental needs, with extensions granted only if necessary for a just resolution. Scotland: timetables are set under the Court of Session Rules and Sheriff Court Ordinary Cause Rules (including commercial and family actions). Children’s referrals and permanence/adoption cases have specific statutory timescales; there is no universal 26‑week limit. Northern Ireland and Ireland: courts set directions and timetables under the court rules; there is no statutory 26‑week limit, but childcare cases are actively case managed to avoid delay. A realistic timetable promotes proportionality and early issue identification; non-compliance may attract sanctions or revised directions.

Illustrative timetable for a UK public takeover by scheme of arrangement under the City Code and Companies Court process

This is an illustrative timetable for a takeover structured as a scheme of arrangement. It sets out the typical stages of a scheme, spanning the necessary court procedures and the obligations arising under the City Code on Takeovers and Mergers (the Code). In broad terms, it captures each step required in a standard scheme process. For schemes, Rule 31 of the Code, which governs the timing of an offer, does not apply; instead, timing matters are addressed principally in Section 3 of Appendix 7 to the Code. Because the court process must be accommodated, the Takeover Panel (Panel) permits greater flexibility on the scheme timetable than on an offer. Even so, the Code imposes certain constraints on the scheduling of a scheme, including: where the offeror’s firm intention announcement contains a statement from the offeree board that it intends to recommend the scheme, the scheme circular, combining an offer document and the offeree circular, must be posted within 28 days of the firm intention...

POCA 2002 confiscation: timetable, s16/s17/s18 statements and responses (England and Wales)

Under section 14 of the Proceeds of Crime Act 2002 (POCA 2002), the court will ordinarily impose a confiscation order before passing sentence on the defendant, yet it can defer the confiscation proceedings for a defined period of up to two years from the date of conviction-see Practice Note: Postponement of confiscation proceedings. If proceedings are postponed, the court will typically direct a timetable for the exchange of material required by POCA 2002 (frequently referred to as the confiscation timetable). The outline below identifies the documents exchanged for these purposes, the point at which they are required, and key points for practitioners to bear in mind when reviewing them. Document: Required where: Commentary Information by defendant in response to an order under POCA 2002, s 18 Where the court proceeds to make a confiscation order under POCA 2002, s 6(3)(a) (the prosecutor seeks an order) or POCA 2002, s 6(3)(b) (the court considers it proper to make an order), or where the court is deciding whether to...

EU competition update: General Court upholds Česká pošta USO compensation; upholds Commission refusal of access to Luxembourg ATAs; merger clearances, filings and appeal; FSR ADNOC/Covestro timetable suspended

State aid General Court dismisses action relating to Commission’s decision approving compensation to Česká pošta for universal service obligations The General Court delivered its ruling in Case T-784/22, Zásilkovna v Commission, a challenge to the Commission’s decision of 25 July 2022, which concluded that compensation granted to Česká pošta by the Czech Republic for carrying out the universal postal service obligation for the years 2018-2022 was compatible with the internal market (SA.55208). The General Court rejected the action in full. By its ruling, the Court endorsed the Commission’s approval of the compensation measure. Background Česká pošta, the incumbent postal operator in the Czech Republic, has been designated as the country’s universal postal service provider. Under the universal service obligation (USO), Česká pošta is required, amongst other duties, to make available specified letter and parcel delivery services on each business day throughout the whole territory of the Czech Republic. The General Court upheld this decision on appeal. In January 2018, the Czech authorities pre-notified compensation intended for Česká...

Legal due diligence reporting in UK private equity buyouts: process, scope, executive summaries, third-party reliance and drafting (including exceptions-only reports and precedent)

This Practice Note forms part of the Lexis+® UK Corporate private equity buyout transaction toolkit. The reporting process Every adviser appointed to carry out due diligence ought to flag principal findings as they emerge, particularly any significant risks or concerns, and then prepare a due diligence report to highlight material issues arising from their review work and analysis. The advisers’ engagement letters must clearly define the agreed timetable, format and scope of the due diligence report. Draft or interim reports can be produced and shared at intervals during the process, enabling material issues to be promptly addressed as they arise. Frequently, by the point the final report goes to the private equity investor, they will be aware of all material matters that could affect the transaction in question. The aim of a legal due diligence report is to: provide the investor with adequate information about the target and to summarise that material in a succinct and comprehensive ...

For an introduction to the UNCITRAL Rules, see Practice Note: UNCITRAL Rules—background and introduction. For guidance on appointing the tribunal, see Practice Note: UNCITRAL Rules—appointment of the arbitral tribunal. General power of the arbitral tribunal The tribunal may conduct the proceedings in such manner as it deems appropriate, provided it treats the parties equally and affords each party a reasonable opportunity to present its case (UNCITRAL Rules, Article 17(1)). The broad discretion conferred on the tribunal is a fundamental tenet of UNCITRAL arbitration and is derived from the original 1976 UNCITRAL Rules...
