What does Transactional video-on-demand (TVOD) services mean?
Transactional video-on-demand (TVOD) services are on-demand audiovisual services where users pay per item (for example to stream a film once, or to download‑to‑rent or buy) rather than by recurring subscription. They commonly include pay‑per‑view sports events and per‑title film rentals or purchases via platforms such as Apple TV Store or Amazon’s Prime Video Store. TVOD is an industry description, not a defined statutory term in the UK or Ireland. In legal analysis it sits within the wider regulation of on‑demand audiovisual media services: in the UK, the on‑demand programme service (ODPS) regime under the Communications Act 2003 and Audiovisual Media Services Regulations (regulated by Ofcom); in Ireland, the Broadcasting Act 2009 as amended by the Online Safety and Media Regulation Act 2022 (regulated by Coimisiún na Meán). Usage is consistent across England & Wales, Scotland, Northern Ireland and Ireland. Key legal features include per‑transaction pricing and terms; title‑by‑title rights clearance and geo‑licensing; age‑rating and protection of minors; advertising, sponsorship and product placement rules; consumer law on digital content (including information, pricing transparency and cancellation/refund rules for immediate streaming); data protection; and applicable VAT/e‑commerce obligations. TVOD models are often contrasted with subscription VOD (SVOD) in distribution agreements and platform terms.
