Unless order meaning

What does Unless order mean?
An unless order is a conditional case management order in civil proceedings stating that a specified sanction will take effect automatically if a party fails to take an identified step by a stated deadline. It is used to compel compliance with rules, directions or timetables (for example service of disclosure, witness statements or pleadings). Sanctions include striking out a claim or defence, debarring reliance on evidence, entering judgment, and costs orders. The term is descriptive rather than statutory. In England and Wales it reflects CPR powers to make conditional orders (CPR 3.1) with automatic sanctions (CPR 3.8) and relief from sanctions (CPR 3.9; Denton). Northern Ireland procedure is similar under the Rules of the Court of Judicature (NI). In Scotland, equivalent effect is achieved through peremptory orders under the Court of Session and sheriff court rules, where non-compliance may result in decree or dismissal. In Ireland, courts make “unless” or peremptory orders under the Rules of the Superior Courts, notably for discovery or pleading defaults. Unless orders are self-executing: on breach, the sanction bites without further order. Parties should apply promptly to vary or extend before expiry; after breach, an application for relief or to set aside will be required.

Regulated activities and exclusions Section 19 of the Financial Services and Markets Act 2000 (FSMA 2000) bars any individual or entity from undertaking, or holding themselves out as undertaking, a regulated activity in the UK unless they are authorised or exempt under FSMA 2000 (the General Prohibition).
