The European Commission (the Commission) has, for the first time, sent informal guidance letters relying on its updated 2022 Notice on Informal Guidance (the 2022 notice). The letters examine how sustainability principles apply to co-operation arrangements in the transport industry. Beyond being the inaugural letters issued under the previously little-used 2022 notice, the APM comfort letter is also the first occasion on which the Commission has applied the 2023 revised Guidelines on Horizontal Co-operation Agreements (the 2023 guidelines) to a sustainability initiative. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
