LIBOR and benchmarks

The Financial Conduct Authority (FCA) has issued a notice compelling ICE Benchmark Administration Limited (IBA) to keep publishing the 1‑month, 3‑month and 6‑month US Dollar LIBOR settings for a further three months. This period begins immediately after the US Dollar LIBOR Versions published up to and including 28 June 2024 have concluded, and runs until just after the final publication on 30 September 2024. This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval.
