JCT releases 2024 editions of Major Project, Constructing Excellence, and Prime Cost contracts

On 16 October 2024, JCT published the 2024 versions of its Major Project Construction Contract, Prime Cost Building Contract and Constructing Excellence Contract, together with the associated sub-contracts and guides. Binding nature of dispositive part of award and revival of tribunal’s jurisdiction in English arbitration (AZ v BY)

In AZ v BY [2024] EWHC 1847 (Comm), the Commercial Court confirmed that, for arbitrations under the Arbitration Act 1996, the dispositive wording of an award is binding. The court held that this language amounts to a complete statement of the tribunal’s granted remedies, akin to the terms of a court order following trial.

It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential.
