Standard form contracts

  • JCT has confirmed the timetable for the 2024 Intermediate Building Contract suite, with publication set for 10 July 2024. Alongside the core contracts, sub-contracts and guidance, JCT will also issue the Intermediate Building Contract 2024 and the Intermediate Building Contract with contractor’s design 2024 Admin – Contract Administration Model Forms. These materials will be available via the JCT online store, JCT On Demand or the Construct digital subscription service, or to order in hard copy from the release date, with reference copies appearing on Lexis+® within Practice Note: JCT contracts 2024 shortly after publication. This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each.
