Decision to prosecute and alternatives to prosecution

Güralp Systems loses bid to escalate plea deal challenge to UK Supreme Court

Güralp Systems has failed in its effort to refer a ruling that upholds a UK bribery plea agreement to the Supreme Court, and now faces the Serious Fraud Office (SFO) moving the court to enforce the deal. The attempt to escalate the dispute has therefore been rejected at this stage, leaving the agreement capable of being imposed by the judges if the SFO proceeds.

The seismic testing company contended it was not responsible because, by the time the agreement expired, the SFO had not informed the court that the £2m remained unpaid. Owing to this breach, Güralp Systems could now be subject to criminal prosecution. See News Analysis: Güralp Systems loses bid to escalate plea deal challenge to UK Supreme Court...

Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
