Government publishes further guidance on powers under the National Security and Investment Act

The government has issued updated guidance on deploying powers under the National Security and Investment Act 2021 (NSI Act), which allows it to examine and intervene in corporate transactions to safeguard national security. The refresh adds a new section 3 statement outlining how the government expects to use its powers to call in particular acquisitions for assessment. Further market guidance has also been released on the operation of the NSI Act, including how it can apply to outward direct investment and specific information for universities. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential.
