Non-disclosure agreements

From 1 August 2025, section A1 of the Higher Education and Research Act 2017 took effect, placing an obligation on the governing bodies of higher education providers not to enter into a non-disclosure agreement (NDA) with an individual member of staff (or a member or student of the provider, or a visiting speaker) where a complaint has been made by them to the provider concerning misconduct or alleged misconduct by any person (‘misconduct’ encompassing bullying, harassment or sexual abuse)...

It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential.
