These Regulations modify provisions of SI 194/2021 European Union (Anti-Money Laundering: Beneficial Ownership of Trusts) Regulations 2021 (Ireland) to further implement Article 31 of the Anti-Money Laundering and Terrorist Financing Directive (AMLD) 4, as revised by AMLD 5, art 1(16). They impose additional obligations on designated persons where particulars of a relevant trust have not been entered in the Central Register of Beneficial Ownership of Trusts. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order.
