Employment Tribunals Reform: FAQ (April 2024)

What are the practical implications of this development?

The core message is that HMCTS continues, albeit at a steady pace, to move forward with its modernisation programme. At present, MyHMCTS is live only in the early adopter locations (Glasgow, Leeds, Bristol and Nottingham). The most notable updates are:

  • MyHMCTS now covers all claim types within the early adopter sites
  • Functionality allowing professional users to file an ET1 through MyHMCTS will be launched shortly, and the current online ET1 submission route in those sites will be withdrawn
  • The reformed service will be extended to the remaining offices soon, using a phased rollout over three months, meaning all employment tribunal offices should be operating the reformed service by the summer

Practitioners are advised to get acquainted with the MyHMCTS portal and register if they have not already done so. Recorded webinars and a Frequently Asked Questions document are available to help users understand the process.

It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
