Local government reorganisation

MHCLG publishes decisions on local government reorganisation

The Ministry of Housing, Communities and Local Government (MHCLG) has issued an update letter confirming that no determination has yet been reached on proposals for local government reorganisation in East Sussex and Brighton and Hove, with further assessment ongoing before arrangements are finalised. MHCLG has also released consultation findings and letters confirming implementation in devolution priority areas to create:

  1. five unitary councils in Essex, Southend-on-Sea and Thurrock,
  2. five unitary councils (option 1A) in Hampshire, Isle of Wight, Portsmouth and Southampton, and
  3. three unitary councils in each of Norfolk and Suffolk.

Council leaders were formally advised of these outcomes by letter. See: LNB News 25/03/2026 69.

Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
