Remediation contribution orders can be retrospective

The Court of Appeal heard Triathlon Homes v Stratford Village Development Partnership & Others together with Adriatic Land 5 Ltd v Leaseholders of Hippersley Point in March 2025 (Triathlon Homes LLP v Stratford Village Development Partnership and other companies (Secretary of State for Housing, Communities and Local Government, intervening) [2025] EWCA Civ 846). The shared issue across both matters concerned whether key provisions of the Building Safety Act 2022 (BSA 2022) operate with retrospective effect.
