Supreme Court confirms child element of Universal Credit is not a family benefit under EU co-ordination rules (Simkova v Secretary of State for Work and Pensions)

The Supreme Court unanimously rejected an appeal brought by a Slovak national living in England, concerning entitlement to the child element of Universal Credit in circumstances where the claimant’s child lived outside the UK. It decided that the child element of universal credit (UC) does not constitute a ‘family benefit’ for the purposes of Article 3(1)(j) of Regulation (EC) No 883/2004 on the co-ordination of social security systems accordingly...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval.
