DBT updates overseas entities register guidance on trust information access

The Department for Business and Trade has refreshed its Register of Overseas Entities guidance to explain new routes for accessing trust information, in force from 31 August 2025. A legitimate interest must be shown for requests covering multiple entities or those involving under‑18s. Companies House may set terms on how the data is used and can decline requests on grounds such as national security or active criminal investigations. See: LNB News 01/09/2025 8...

It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
