ICO updates data protection by design guidance following DUAA 2025 commencement

The Information Commissioner’s Office (ICO) has issued refreshed guidance on data protection by design and by default to align with the commencement of key provisions of the Data (Use and Access) Act 2025 (DUAA 2025). The guidance stresses that organisations should weave data protection into the creation and running of systems, services, products and processes, so that only the minimum personal data needed for each specified purpose is gathered, used, kept and accessed. It sets out the need for suitable technical and organisational measures, including strong security controls, clear retention approaches, privacy-friendly default settings and routine risk reviews via data protection impact assessments.
