The anti-corruption watchdog said it plans to apply for leave to contest a High Court ruling that ex-SFO staff unlawfully liaised with Neil Gerrard, the former head of white-collar investigations at Dechert LLP, to make unauthorised revelations about his internal probe into ENRC. An appeal in the ten-year dispute loomed as, at a High Court hearing on 25 March 2024, the SFO said it would, ahead of any appeal, pay £9m on account towards ENRC’s wasted costs and legal fees. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
