In THG Plc v Zedra Trust Company (Jersey) Ltd [2026] UKSC 6, the majority judgment of Lord Hodge and Lord Richards, with whom Lord Briggs and Lord Lloyd-Jones concurred, held that CA 2006, ss 994–996 do not impose substantive duties but constitute a remedial jurisdiction addressing unfair prejudice, distinct from proceedings to enforce statutory obligations.
