The CAT has handed down its ruling in Road Haulage Association Limited v Man SE and Others, deciding an application for a collective proceedings order (CPO) arising from follow-on damages claims linked to the Commission’s decision of 19 July 2024, which concluded that five truck makers (MAN, Volvo/Renault, Daimler, Iveco and DAF) engaged in a cartel in markets for the production of heavy and medium duty trucks (Case 39824). It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
