Family provision claim definition

What does Family provision claim mean? A family provision claim is a court application to secure reasonable financial provision from a deceased person’s estate where a will or the intestacy rules do not provide adequately. In England and Wales, the term ordinarily refers to a statutory claim under the Inheritance (Provision for Family and Dependants) Act 1975. Eligible applicants include a spouse or civil partner, former spouse/civil partner (subject to conditions), a cohabitant of two years, a child (including treated-as-child), and any person maintained by the deceased. What is a family provision claim?

This contrasts with many legal systems where Forced Heirship dictates beneficiaries, or earmarks parts of an estate, on death. Yet, this freedom of testation here is limited by statute. We recognise that issuing a claim can feel overwhelming while you mourn a loved one, particularly when you must also face that adequate provision was not made for you. Across many jurisdictions, forced heirship decides beneficiaries, or reserves a portion of estate, on death. A specialist Private Client professional can provide advice tailored to circumstances...

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
