What does Automatic enrolment mean? Automatic enrolment describes the employer duty to place eligible workers into a workplace pension without requiring an application, fund statutory minimum contributions, provide prescribed information and operate opt-out and periodic re-enrolment. In England & Wales and Scotland, it is a statutory regime under the Pensions Act 2008 and regulations (mirrored in Northern Ireland by the Pensions (No. 2) Act (Northern Ireland) 2008). Automatic enrolment does not apply to workers under age 22.

Individuals younger than 22 fall outside automatic enrolment. However, anyone aged 16 to 21 with qualifying Earnings of £6,032 or above in the 2018–19 tax year may choose to join their employer’s automatic enrolment arrangement and receive employer pension contributions.

For the purposes of limb (a) in section 230(3) of the Employment Rights Act 1996 (ERA 1996), a worker is an individual who has entered into, or works or worked under, a Contract of employment. Under ERA 1996, section 230(2), a contract of employment means a contract of service or apprenticeship.
