Respondent definition

What does Respondent mean? In practice, the respondent is the party who answers or resists an application, petition, appeal, arbitration or tribunal claim, rather than initiating it. The label is used across many forums and its precise use is set by the applicable procedural rules (for example, civil and family appeals, employment tribunals, regulatory proceedings, arbitration rules, and judicial review). Usage is broadly consistent across England & Wales, Scotland, Northern Ireland and Ireland: - First‑instance civil actions generally use defendant (England & Wales, Northern Ireland, Ireland) or defender (Scotland). - In appeals, petitions and tribunal proceedings, the non‑moving party is usually called the respondent. - In statutory construction...

Personal service of a Divorce petition

It is inferred that this Q&A concerns personal service of a divorce petition, given the mention of the ‘petitioner’. As a starting point, a divorce petition is commonly served on the Respondent by first class post. That said, Family Procedure Rules 2010 (FPR 2010), SI 2010/2955, 6.4 permits service of a divorce petition by other means, namely:

  • personal service pursuant to FPR 2010, SI 2010/2955, 6.7
  • alternative service providing delivery on the next business day under FPR 2010, PD 6A
  • where FPR 2010, SI 2010/2955, 6.11 applies (the respondent has a solicitor acting and the applicant has written notice that the solicitor is instructed to accept service of the application), service via document exchange (DX)

This Practice Note This Practice Note reviews mechanisms used in settling litigation. A Tomlin order consists of a consent order paired with a schedule. It operates to stay proceedings on terms that have been agreed. The provisions contained in the schedule may remain confidential. This Practice Note describes the scope of confidentiality attaching to the schedule and sets out how it differs from a standard consent order. Sample wording for a Tomlin order is included, alongside links to precedents, as well as guidance on court approval. It also addresses varying, setting aside and enforcing a Tomlin order, including the considerations the court will take into account when handling applications for each. Further guidance is provided on interpreting and applying the relevant provisions of the CPR; however, some courts and divisions impose very specific requirements for both drafting and approval, and for approaching the schedule and confidentiality issues. Accordingly, you must consider the particular rules and court guide provisions in the forum where your claim is proceeding when drawing up the Tomlin order...
